ANRE Order 97/2013 (free translation)

Order no. 97/2013 on the approval of rules on purchasing electricity to cover the own technological consumption related to power grids

–          published in the Official Gazette of Romania, Part I, no. 8 of January 7^th 2014 –

 pursuant to provisions of art. 5 paragraph (1) letter c) and paragraph (5) of art. 9 paragraph (1) letter h) of Government Emergency Ordinance no. 33/2007 on the organization and functioning of the National Energy Regulatory Authority, approved with amendments and additions under Law no. 160/2012,

President of the National Energy Regulatory Authority issues this order.

Art. 1. –

(1) Network operators shall purchase electricity over a medium and long term from the centralized markets for electricity bilateral contracts and are entitled to perform sale-purchase operations on the day ahead market and the intra-day market only to cover their own technological consumption, hereinafter referred to as CPT, related to power grids.

(2) For the purpose of this order, network operator designates the transmission and system operator and distribution operators.

Art. 2. –

(1) Each network operator shall be registered as responsible party with distinct balancing for purchasing electricity to cover CPT.

(2) In order to minimize costs with imbalances, network operators are entitled to transfer their balancing responsibility to any party responsible with balancing registered with the transmission and system operator, according to regulations in force.

(3) In case of transferring the responsibility of balancing, according to paragraph (2), the party responsible with balancing that takes over the responsibility of balancing a network operator is required to endorse at the National Energy Regulatory Authority the procedure of allocating imbalances to its members.

Art. 3. –

The electricity market operator, transmission and system operator and distribution operators shall fulfil the provisions of this order.

Art. 4. –

Organizational entities of the National Energy Regulatory Authority shall monitor the fulfilment of this Order.

Art. 5. –

This Order shall be published in the Official Gazette of Romania, Part I.
