Order no. 52/2014 amending the Appendix to the Order of the President of the National Energy Regulatory Authority no. 88/2013 on the approval of the regulated tariff charged by the electricity market operator

In consideration of the provisions of art. 75 paragraph (1) letter g), art. 76 paragraph (1) and art. 79 paragraph (3) of the Electricity and Natural Gas Law no. 123/2012, with subsequent amendments and additions, of art. 23 of the Methodology for setting the regulated tariff charged by the electricity market operator, approved by Order of the President of the National Energy Regulatory Authority no. 67/2013, and the request of the Operator of the Electricity and Natural Gas Market OPCOM – S.A. no. 39.433 of June 20th 2014, registered with the National Energy Regulatory Authority under no. 38.195 of June 20th 2014,

Pursuant to art. 5 paragraph (1) letter b) and paragraph (5) and art. 9 paragraph (1) letter c) of Government Emergency Ordinance no. 33/2007 on the organization and functioning of the National Energy Regulatory Authority, approved with amendments and additions by Law no. 160/2012,

the President of the National Energy Regulatory Authority issues this Order.

Art. I. – In the table of the Appendix to the Order of the President of the National Energy Regulatory Authority no. 88/2013 on the approval of the regulated tariff charged by the electricity market operator, published in the Official Gazette of Romania, Part I, no. 788 of December 16th 2013, with subsequent amendments, at the component of performing transactions on the centralized markets in which the electricity market operator is counterparty T_{tranz counterparty}, the regulated tariff charged by the electricity market operator shall change as follows:

Art. II. – The Operator of the Electricity and Natural Gas Market OPCOM – S.A. and economic operators in the electricity sector shall fulfill the provisions of this Order.

Art. III. – The specialized departments of the National Energy Regulatory Authority shall monitor the compliance with the provisions of this Order.

Art. IV. – This Order shall be published in the Official Gazette of Romania, Part I, and shall enter into force on 1 July 2014.
